Terms and Conditions
These “Terms and Conditions" govern you (“The User”) in your use of the MYOGENIC BIO-ENGINEERED NUTRITION (hereinafter named “Myogenic NZ Ltd”) www.myogenic.co.nz website ("The Website"). Accessing The Website gives your consent that you agree to be bound by these Terms and Conditions as set out in this notice.
Payment Options and Security Policy
All transactions will be processed in New Zealand currency (NZD).
We only accept credit card payment for orders via The Website.
Security Policy and E-commerce Privacy
Our checkout pages are secure and encrypted using SSL, and all Credit Card transactions are verified in real time using Direct Payment Solutions (DPS).
Please note that to protect Myogenic and the interests of customers, we check all transactions very carefully to help prevent attempted fraud. A transaction may be refused if Myogenic is not satisfied with its legitimacy.
DPS process all credit card transactions on behalf of Myogenic via The Website
Your private information required for processing your orders placed through The Website will be kept in the strictest confidence by Myogenic NZ Ltd and not sold or made known to third parties, namely your personal information, credit card details, delivery address and telephone numbers. Only necessary information, namely your delivery address and contact phone number will be made known to third parties appointed by Myogenic to deliver your order.
Please note that Credit Card details are not requested by, collected or submitted to Myogenic NZ Ltd systems. Credit Card details are requested by DPS on our behalf and are protected by them.

Agreement of Sale and Order Confirmation
An agreement of sale and order confirmation between Myogenic NZ Ltd and a user only comes into effect when a credit card authorisation is received from the issuing bank. Adding products to your “shopping cart” does not constitute an agreement of sale or order confirmation. Myogenic NZ Ltd reserve the right to decline any sale at any point, in such instances the user will be refunded any monies which may have been received.
We reserve the right to decline an order for any reason.
Myogenic NZ Ltd do not offer products or services to minors, if you are under the age of 18, you may not respond to or accept or act upon any offers in the Website.
Shipping and Handling Information
Calculating Delivery Dates
We ship most orders within 1 business day of receipt of confirmed sale. Orders are shipped via our elected courier company.
Please be aware that orders placed after midday on a business day will usually be dispatched the next business day. Our Courier does not deliver on weekends or public holidays, as such please do not include these days when estimating your expected delivery date.
Delivery Addresses
Our Courier does not deliver to P.O. Boxes so you must provide a valid New Zealand street address for delivery at time of placing your order.
Delivery Charges
Delivery charges are calculated by the website at the time you place an order and are charged to your order toal during online payment.
Charges are as follows:
- Auckland Metropolitan Area: $5.00
- Rest of North Island: $10.00
- South Island: $15.00
We reserve the right to vary the freight charges either as per customer instructions or as per courier pricing tables that may apply
Signature Upon Delivery
We require a signature upon delivery of your parcel, therefore please ensure that there is somebody available to receive the parcel at the address you provide. Please inspect the parcel and condition of the box upon receipt, if the box is visibly damaged please mark this information on the waybill or delivery note presented to you by the courier.
Delivery Problems
A special fee will apply for shipments that are either re-routed after leaving our warehouse or are incorrectly addressed due to the customer's error. This extra cost will generally be the standard freight fee, ex the Auckland warehouse but other factors may apply. We generate Address labels directly from the shipping information you have entered when creating your account. If you provide us an incorrect area code or other address error e.g. incorrect or missing house or apartment number, you will be charged a fee since the Courier Company will charge us a fee for this correction.
International Orders
We do not currently complete orders via The Website for shipment to international destinations (those outside New Zealand). Orders can be requested for shipment to countries other than New Zealand, but the payment for these cannot be completed at The Website. For shipments to countries other than New Zealand please place an order through The Website and follow the instructions, or contact us directly.
Goods and Services Tax
All product prices as advertised on The Website are inclusive of GST at 12.5%.
Damages and Shortages
Products damaged during shipping or missing items must be reported to Myogenic NZ Ltd within 24 hours of receipt. Myogenic NZ Ltd will then either issue you credit or send replacements for the amount of any confirmed damaged or missing products. Myogenic NZ Ltd may contact the courier company for visual inspection of the products and box. Myogenic NZ Ltd will then either issue a credit or send replacements for the amount of any confirmed damaged or missing products.
Returns
You must contact our distribution agent for a return authorisation number prior to returning any products. Please contact Denby Distribution on +64 9 527 6184 and have your order number ready. Products must be returned in unopened and original condition in order to receive credit. A valid return authorisation number must be on the shipping label or we will refuse the package. Full credit will be issued for unopened products returned within 7 days of your receipt of shipment. No product returns will be accepted after 7 days of your receipt of shipment.
If we ship you an item other than what you ordered, do not open the product or it will void your right to return it. Please contact Denby Distribution on +64 9 527 6184 so the item can be exchanged and the correct item returned to you at no cost.
Couriers charge us for the return of undeliverable packages, including, but not limited to, refused packages and those where delivery attempts proved unsuccessful. If your package is returned to us for any of these reasons, you will be responsible for additional shipping costs.
Back Orders
We stock all items advertised on The Website. Although every attempt is made to maintain inventory of each product, occasionally we may run out of certain products. In this case, we will mark the product "Out of Stock" on The Website. Products that are marked “Out of Stock” are unable to be ordered via The Website.
